No. 11/A.Bibidh-03/2006 (Khand) 610-(11)—In exercise of the powers conferred by
proviso to Article- 309 of the Constitution of India, the Governor of Bihar is pleased to make the
following rules for regulation of recruitment and service conditions of Ophthalmic Assistants
Joint Cadre.
CHAPTER –I
प्रेलिमिनारी
1. Short title, extent and commencement.—
(1) These rules may called the Bihar Ophthalmic Assistants Joint Cadre (recruitment
and service conditions) Rules, 2011.
(2) These shall extend to Directorate of health and its attached offices of the State
Government.
(3) These shall come into force with immediate effect.
2. Definitions –Unless there in any thing repugnant to the Subject or Context, in these
Rules-
(i) “Directorate and Hospitals” means Directorate of health including Medical
colleges, Training Centre, Central ophthalmic Mobile units, District hospitals,
District Ophthalmic Mobile Units, Sub-divisional Hospitals, State and urban
hospitals, Referral hospitals and Primary health Centre.
(ii) “Joint Cadre” means the joint cadre of ophthalmic Assistants, ophthalmic
officer, senior ophthalmic officer, chief ophthalmic officer, Tutor cum incharge
ophthalmic officer, Lecturer, Associate professor working in the
Directorate and attached offices.
(iii) “State Government” means the Government of Bihar.
(iv) “ Commission” means the Bihar Staff selection commission.
(v) “ Appointing Authority” means the authority prescribed under rule-3.
(vi) “Grade” means the grade prescribed under rule-3 and
(vii) “Merit list” means:-
(a) The merit-cum-seniority list predetermined by the Directorate of Health,
as prepared for first, Second and third batches respectively.
(b) There after the merit-cum-seniority of fourth batch as prepared by the
Directorate of health.
(c) There after the selection list of the candidates recommended by the
commission.

CHAPTER -2
POST /GRADE
3. The post/grade of ophthalmic Assistant Joint Cadre.—
(1) The post of different Grades, their classification and appointing authority- The
posts of different grades in the cadre, their classification and their appointing
authorities shall be as follows or as per the criteria determined by the State
Government from time to time :-

(2) The number of posts in different grades shall be in the following ratio.—
Revised Pay
(I) General Grade/Basic Grade- (4500-7000) (5200-20200) - 53%
(II) Grade –III (5500-9000) (9300-34800) - 25%
(III) Grade-II (6500-10,500) (9300-34800) - 20%
(IV) Grade –I (8000-13,500) (9300-34800) - 02%
(3) Group of posts.—The creation of grade wise additional permanent or temporary
posts in any category of the cadre shall be made according to need.
(4) Administrative Control over the members of the Cadre.—The posts of all grades in
the cadre and members of the cadre shall be under the administrative control of the Directorate of
health services, Bihar.
(5) Operational Control—The members of the cadre shall be under the operational
control of the Head of the office to which they are posted.
(6) Notifications of appointments, postings etc.—The appointments, promotions,
postings and confirmations of all the nongazetted posts in the cadre shall be made under office
orders by the Director-in chief, health Services. In the context of gazetted posts notifications shall
be issued in the official gazetted as per rule.
(7) Fixation of Seniority.—The seniority list shall be based on the merit list determined
for appointment by commission which will be placed just below the predetermined seniority list.
(8) Confirmation-
(a) The Service shall be confirmed after first appointment and completion of
probation period of two years, passing the departmental examination and
not having any departmental allegations.
(b) The probation period if not completed satisfactorily, then even during the
probation or at the time of completion of probation period appointee may be
terminated from service.
(c) The courses and procedure of departmental examination may be determined
by the Directorate of health Services under a separate order.
CHAPTER -3
RECRUITMENT
4. Hierarchy in the cadre.—The post of ophthalmic Assistant shall be the basic level
post. After selection of ophthalmic Assistant by Bihar combined competitive examination Two
Years Diploma course shall be given by the selected medical colleges. After publishing an
advertisement and completing the necessary procedures by the commission a selection-cum merit
list shall be prepared and recommended to the Director-in chief, health services for appointment.
The vacancies to all the posts higher to the ophthalmic Assistant shall be filled by
promotion from the just lower posts. The recommendation/consent of Departmental promotion
committee shall be obtained in the proposals of promotion.
All the teaching posts shall be filled by promotion from basic post ophthalmic Assistant
having eight, twelve & fifteen years working experience for Tutor, lecturer and Associate
Professor respectively. Promotion shall be considered by the promotion committee constituted
by Health Department.

5. Minimum Qualification .—
(I) The minimum age shall be 18 years and the maximum age limit shall the
same as may be determined grade wise by the State Government/General
Administrative Department from time to time.
(II) The minimum educational qualification shall be I.Sc. /10+2 (Biology)
passed and having a pass certificate of Diploma course prescribed for
ophthalmic Assistant.
6. Reservation in appointments.—
(a) After clearance of roster as per the actual and probable vacancies, reservation
category wise requisition shall be sent to the commission.
(b) Only the natives of the Bihar State and passed from the medical colleges of
Bihar shall be deemed eligible for appointment.
7. Validity of Merit list.—The merit list recommended by the commission shall remain
valid till the appointment of the candidates or for a period of one year from the receipt of the
recommendation in the department whichever is earlier. Only such numbers of the candidates
shall be recommended by the commission as have been requisitioned. There shall not be any
waiting panel.
CHAPTER-4
PROMOTION
8. Promotion to higher grades from the general grade (Basic grade) may be made as
follows –

9. Selection criteria for promotion.—
(1) The criteria of suitability of candidates for promotion under the cadre
shall be the principle of “Seniority-cum-merit” for first and second
promotion while the third and last promotion shall be on the principle of
“Merit cum Seniority”
(2) The completion of qualifying period (kalavadhi) for promotion
prescribed from time to time by the State government personal and
Administrative Reforms (General Administration) Department shall be
essential
10. Selection procedure.—The proposals of promotions shall be considered by the
departmental promotion committee which will be constituted as follows-

11. Saving and Repeal.—All the rules/resolutions/instructions applicable to the cadre
prior to the commencement of these Rule shall deemed repealed.
Not withstanding such repeal, action taken or any thing done under the repealed
rules/resolutions/instructions shall deemed to be taken or done under these rules.
12. Remedy of Doubts.—If any doubt arises in the interpretation of any provision of
these Rules, that shall be referred to the Health Department and its decision will be final.
